79th Legislative Session
• HB 160 Relating to motor vehicles equipped with recording devices.

In addition to the above mentioned legislation, a number of bills which I have authored or sponsored have also been attached to other bills in the form of amendments. Some of these bills include the addition of one county court and two district courts in Collin County, a biotechnology economic development incentive, and the local option election for the sale of wine and beer.
During the 78th legislative session Brian McCall passed a number of measures to protect your privacy and security.
He enhanced the criminal penalty for identity theft, protected social security card numbers by prohibiting the printing of SS numbers on an identification card or health insurance card. Furthermore, McCall legislation prohibits the use of whole credit card numbers being printed on consumer receipts; further protecting Texans from identity theft.
Brian also guided the state fiscal management bill through the process this session. The bill accounts for nearly $900 Million to the current budget through creating new investment tools for Comptroller Strayhorn. This fiscal bill also created an economic development tool for Governor Perry to help bring biotechnology companies to North Texas.
In the area of criminal justice, he expanded the current population of inmates that we currently take DNA blood samples from to include capital murder offenders. McCall also protected the Texas information technology infrastructure by having state agencies conduct criminal background checks of employees or contractors who oversee our state databases and web portals.
Finally, Brian created a civil penalty for unsolicited email commonly known as "SPAM" in addition to making unsolicited adult advertisements a criminal penalty.
During the 77th Session:
- Rep. McCall successfully amended the appropriations bill that saved "Robin Hood" school districts at least $70 Million (including saving the Plano
- Independent School District at least $8 million).
- Passed one of the most comprehensive State Privacy Policies in the United States.
- Passed a franchise tax credit for business which pay wages to persons with disabilities.
- Passed an initiative to move government online, making citizens' dealings with state government easier and saving the state $211 million.
- Provided a mechanism for victims of identity theft to clean up their records.
- Worked to secure a $500,000 appropriation to the University of Texas at Dallas to help fund a nanotechnology center.
- Put $10.2 million in budget (to be matched dollar for dollar from industry) to double the output of engineers graduating from Texas universities.
- Passed Sunset legislation aimed at making government more efficient and accessible to its constituents.
During the 76th Session:
Representative McCall authored and passed:
- A half billion dollar tax cut plan, which among other things creates a tax holiday for three days each August, removes taxes from over the counter medicines, exempts small business from the Franchise tax, creates Investment and Research and Development Tax Credits, and provides tax credits for employers who provide day care
- The "Truth in Employment" bill which allows employers to give truthful references without fear of liability
- Bills which making Assisted Living Facilities
and Home Health Services meet new standards for quality of care - An act which limits liability and forces solutions for Y2K liability problems
- A bill which allows the Department of Criminal Justice and the Texas Youth Commission to obtain DNA samples from sex offenders
- And a number of comprehensive bills which reorganized various state agencies to increase their efficiency, including the Texas Department of Health, the Department of Criminal Justice, the Center for Rural Health Initiatives, the Board of Pardons and Paroles, Comptroller of Public Accounts, and the Texas Planning Council for Developmental Disabilities.
During the 75th Session:
Significant legislation Representative McCall passed include bills:
- Which Define Protective Orders
- Correct the constitutional concerns regarding the Offense of Stalking
- Prohibit discrimination in determining employment eligibility and coverage under certain health benefit plans based on the results of genetic testing
- Allow women access to obstetrical or gynecological health care under a health benefit plan
- Define minimum coverage required under certain health benefit plans for inpatient stays and post-delivery care following child birth
- Mandate coverage of tests for detection of prostate cancer under health benefit plans
- Amend the starting date for the statute of limitations for the misappropriation of trade secrets.
During the 74th Session:
Representative McCall was instrumental in passing bills:
- On DNA Fingerprinting
- Tort of Stalking
- Notification of a Victim of Stalking, and Elimination of Free Stalk
- Protective Orders for Victims of Family Violence
- Insurance Based on Claims Paid not Filed
- License Revocation for Failure to Pay Child Support
- A fourth County Court at Law and a new District Court for Collin County.
During the 73rd Session:
Significant legislation passed by Representative McCall included bills:
- That made stalking a criminal offense
- Established higher standards for mammography screening
- Created a series of affordable basic health benefit plans for small businesses employing three to fifty people
- Established a pilot program to help teenage mothers finish their education
- Set up a formal structure for the reporting of technological innovations developed in Texas state agencies
- Set up licensure, regulation and minimum standards for adult day care facilities.
